- 18 May 2026: The US Government opened a case under the United States–Mexico–Canada Agreement (USMCA) Rapid Response Labor Mechanism (RRM), alleging labour rights violations at an auto parts manufacturer in Mexico.
USMCA RRM
- USMCA is the regional trade agreement between the US, Mexico, and Canada, which came into force in 2020. The Rapid Response Mechanism (RRM) is a site-level enforcement mechanism established under the agreement that allows the US and Mexico to challenge alleged violations of freedom of association and collective bargaining rights at specific facilities. Canada has a separate mechanism, though it has seen minimal use.
- To date, 46 cases have been filed, the majority involving the automotive sector (24).
- Disputes are typically reviewed and addressed within around 75 days.
Case details
- The case was raised against Faurecia Sistemas Automotrices de Mexico, an auto parts manufacturer that forms part of the France-based automotive supplier FORVIA.
- The case follows an April 2026 petition filed under the RRM by union SINTTIA, alleging interference in union activity and unlawful dismissals linked to union organising. The petition itself does not appear to be public.
- The allegations are consistent with a common pattern in RRM cases involving alleged interference with independent union activity. Reported actions include threats, interrogations and dismissals of workers in retaliation for supporting SINTTIA.
- A notable feature of the case is the alleged involvement of both the employer and the incumbent union, STIA-CTC. While not unprecedented, similar allegations have arisen in cases involving Thyssen and Mondelez, this remains less common.
- While the review is ongoing, the USTR has suspended final customs clearance for goods produced at the facility.
Next steps
- Mexico has 10 days to decide whether it will conduct a review. If accepted, it has 45 days from 18 May 2026 to complete the review.
- RRM cases are often resolved through remediation measures rather than formal sanctions. Outcomes have included worker reinstatement, backpay, wage increases, union elections and recognition of independent unions.
